1. Acceptance of terms

By accessing or using PixelCache (the "Service") at pixelcache.org, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

If you are under the age of 13 (or under 16 in the EU/UK), you must have permission from a parent or legal guardian to use the Service.

2. Description of the Service

PixelCache is a free, browser-based library of classic Flash and HTML5 games. Games are loaded either through the Ruffle emulator (for legacy .swf files) or directly via an embedded <iframe>. No download, account, or payment is required.

The Service is provided on an "as is" and "as available" basis and may be changed, suspended, or discontinued at any time without notice.

3. Acceptable use

You agree that, when using the Service, you will not:

  • Use the Service in any way that violates any applicable local, state, national, or international law.
  • Attempt to interfere with, compromise, or disrupt the Service, its servers, or its underlying networks.
  • Use automated systems (bots, scrapers, crawlers) to access the Service in a manner that places an unreasonable load on the infrastructure.
  • Bypass, disable, or otherwise circumvent any security or content-protection mechanisms.
  • Reverse engineer, decompile, or attempt to extract the source code of any part of the Service except to the extent permitted by law.
  • Use the Service to distribute spam, malware, or content that infringes the rights of others.

4. Intellectual property

The PixelCache name, logo, layout, original code, and overall presentation are the property of PixelCache and protected by copyright and trademark law. You may not copy, modify, distribute, or create derivative works of these elements without express written permission.

Individual games available on the Service remain the property of their respective creators and publishers. PixelCache does not claim ownership of any third-party game and provides them for nostalgic and educational access only. If you are a rights holder and believe content has been made available improperly, please see our DMCA policy.

5. Third-party content

Many games on PixelCache load from third-party domains. These third parties have their own terms and privacy policies, which govern your interaction with their content. PixelCache does not control, and is not responsible for, the conduct or content of third-party websites or services accessed through the Service.

6. User data

PixelCache stores small amounts of data in your browser's local storage (favorites, recently played games, play counts, ratings). This data lives only on your device and is never transmitted to our servers. Clearing your browser data will remove it.

7. Advertising

The Service is supported by advertising provided by Google AdSense. By using the Service you acknowledge that ads will be displayed alongside content. Use of an ad blocker is permitted but may degrade some features of the Service. You agree not to engage in fraudulent ad activity (e.g., automated clicks or impressions).

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the Service at your own risk.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PIXELCACHE, ITS OPERATORS, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, REVENUE, OR PROFITS — ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

Our total liability for any claim arising out of these Terms or your use of the Service will not exceed one hundred U.S. dollars (USD $100.00).

10. Indemnification

You agree to defend, indemnify, and hold harmless PixelCache and its operators from any claim, demand, or damage — including reasonable attorneys' fees — arising out of your use of the Service or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, for any reason, without notice. All provisions of these Terms which by their nature should survive termination shall survive — including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator of PixelCache resides, without regard to its conflict-of-law provisions. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the courts of that jurisdiction.

13. Changes to these Terms

We may modify these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. Material changes will be announced on the homepage where reasonably practical. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
